TERMS & CONDITIONS
1. Your acceptance of this agreement
1.1. The Terms and Conditions apply to sales contracts with private and business customers through the website of Michael Sowersby - creative glass. The buyer confirms to have read and understood the Terms and Conditions by clicking the “Check-Box” before entering credit card details in the Checkout-Process.
1.2. The contract is complete when the buyer has paid for the goods in full and the payment has been confirmed. The order will be confirmed by Michael Sowersby - creative glass by separate communication.
1.3. The terms and conditions can be changed by Michael Sowersby - creative glass at any time without further notice.
2. Pricing & Shipping
2.1. All prices are stated in EURO, ex warehouse 4642 Sattledt/Austria, exclusive of VAT(MwSt).
2.2 Shipping and packaging fee (S&P fee) will be listed separately. In cases where S&P fee differ from the shown values, the buyer will be contacted immediately. Depending on weight and volume of the order, the shipment will be effected by post, courier service or freight forwarder. Find further information on shipping & packaging fee here.
2.3. Orders over 30kg will be effected by freight forwarder. Shipping costs will be charged depending on the delivery area upon advance. The final amount will be notified by email or phone when the product is ready. Comes up an open amount you will be charged for that.
2.4. Our prices are binding at the time of order. Michael Sowersby - creative glass always endeavors to provide current and accurate information on the Website. However, pricing errors may sometimes occur. We reserves the right to: (a) correct any prices or pricing errors at any time without prior notice or liability to you or any other person; (b) reject, correct, cancel or terminate any order, including accepted orders for any reason.
2.5. Minimum Order Value is EUR 20.-
3. Shipment
3.1. Delivery is made within 2-10 working days, depends on shipping zone. If any longer delivery time is necessary, the buyer will be informed immediately. A delivery delay does not entitle the buyer to claim damages or to cancel the contract.
3.2. Risk of delivery of goods shall pass to the buyer when the shipment has left the warehouse Michael Sowersby - creative glass or ready for pick-up was reported to the buyer.
3.3. If a product, contrary to the web shop information is not on stock, the buyer will be contacted or the value of the missing item will be refunded.
4. Right of Withdrawal
4.1. Customers have the right to withdraw from the contract within 14 calendar days from receipt of goods in writing. The return shipment of goods is at the risk and expense of the buyer.
4.2. The Product must be returned in perfect condition, complete and in its original packaging. Otherwise we reserve the right to withhold a proportional value.
4.3. Address for returns: Michael Sowersby - creative glass, Hauptstrasse 27, 4642 Sattledt/Austria.
4.4. Exempt from the right of withdrawal are books and templates.
5. Liability and warranty
5.1. The warranty is 12 months (excluded are wearing parts and other specifically labelled products). Claims must be made by means of a receipt or invoice. The return is at the cost and risk of the buyer.
5.2. Excluded of warranty are slight variations (colour, size and weight), normal signs of wear and damages caused by improper handling.
5.3. The buyer is obliged to inspect the goods immediately and report damages within 7 days. Hidden damages can be reported after using the product.
5.4. In the case of a defect, the buyer has the right of free repair, an appropriate discount or replacement. The decision on this depends on the type of defect and will be made by Michael Sowersby - creative glass.
6. Payment
6.1. We accept Creditcards as Visa and Mastercard, as well immediate wire transfer. The value will be charged immediately.
6.2. The goods remain property of Michael Sowersby - creative glass until payment has been made in full.
7. Seminars & Courses
7.1. Your online registration is binding. Confirmation and bill will be sent separately.
7.2. Should you wish to cancel within 4 weeks of the seminar date, we reserve the right to charge 50% of the seminar fee.
7.3. Fees always include materials and meals during seminar hours, if it is not otherwise specified.
8. Governing law and jurisdiction
8.1. These Terms and Conditions are governed solely by the Austrian law.
8.2. Place of performance and exclusive jurisdiction for all parties is 4642 Sattledt/Austria
